The Failure of the 28-Clause Ceasefire Plan for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the crisis caused by the presentation of a new 28-article proposal for ending the war appeared – briefly – to have been contained. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Cycle of Diplomacy and Destruction

The chain of contrasting events captured the harsh reality of the recent timeframe. By day, diplomatic battles are conducted: optimistic declarations are delivered from multiple capitals. Significant resources is expended on managing certain initiatives. By night, Moscow forcefully demonstrates the world that, for them, war remains the primary tool for achieving "settlement".

After-Dark Attacks

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor projectile deployments from across the border, a capacity provided through current data. From vantage locations, defense planes that had been dispatched to engage hostile guided weapons roared overhead – modern combat jets provided to Ukraine by European allies.

Soon thereafter, Kyiv's anti-aircraft weapons activated: defensive missiles targeted at a hostile projectile. This was a modern interception technology at work, presumably supplied through partner states. Every firing creates sudden vibrations, causing tremors. The instant of fear quickly becomes resigned acknowledgment: possibly the approaching threat won't strike its target this time, protecting urban areas from catastrophe and additional electricity failures.

Ongoing Risks

Not long after, a heavy machine gun fired at a drone close by, part of a rapid response unit – almost certainly imported technology. Regrettably, the bullets missed the opposing UAV – it maintained course toward its destination.

With pauses, this continued until dawn. Kyiv greeted the morning news: multiple fatalities, destruction and heating outages in multiple buildings as a result of the nocturnal offensive. As always, everyone still continued their routines – living the war. But those 24 hours illustrated Ukraine's critical military reliance on external assistance – a reliance that European nations are evidently unprepared to replace in the immediate future.

Failed Diplomacy

The 28-point plan from US administration sparked intense emotion, debate and serious worry – and momentarily shifted focus from Ukraine's largest corruption scandal in years. Yet, we have seen this script before, after earlier high-level meetings and international summits.

Every new approach from Washington unfolds according to the consistent cycle: a diplomatic cavalry charge against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually achieve victory. This cycle will, undoubtedly, persist.

Strategic Calculations

It is tempting to accuse certain parties of repeatedly advocating Russian terms. But that does not seem to be the complete picture. US administration operates on a principle well known to seasoned negotiators: you cannot achieve through diplomacy what you have lost on the battlefield. The US administration believes that it is unfeasible to compel Moscow to relinquish the territory that it presently holds in Ukraine's south or east.

The problem is that while accepting these circumstances, American administration does nothing to discourage Russia, through statements or actions, from believing that the situation will not shift further in its favour in the coming year.

Divergent Views

Therefore, the Kremlin is certain that the clock favors them – that Ukraine and its allies are approaching exhaustion. Their reason to sign a deal that does not give them the greatest potential benefit is virtually nonexistent. There may be many attempts to stop fighting, but they will persist as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, slowly losing people and territory but averting a complete military breakdown until conditions improve in its favour.

Current Realities

Realistically, there are no actual prerequisites for a truce. Now, subjective factors are becoming relevant: personal goals to broker a ceasefire and secure international recognition, and Kyiv's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the national cause against any plan Kyiv finds unworkable, so that their attention does not shift toward domestic problems. And although their task will now be much harder after latest incidents, it remains very improbable that this will modify their basic position.

These conflicting dynamics are driving the talks.

Summary and Prospects

It took a only one week to eliminate the proposed articles of the latest plan. Forceful and unpredictable management of the matter by US administration, resistance by Ukraine and the rest of Europe, along with soothing efforts of diplomats, and finally, recent disclosures, all did their job.

While new proposals based on old ideas are imminent, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to fend off political attacks from Washington that are rooted in Kremlin requirements and reflect particular unwillingness to change the course of events, if they stand together and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the predictable period, largely rely on continued Western support.
